Our Terms are simple. Please read them carefully, as we are not open for discussion on these items.
Fishbowl Network is a provider of web hosting services and subsequently requires you to agree to the following terms and conditions before registration can proceed. Fishbowl Network reserves the right to suspend or cancel any service provided by Fishbowl Network if it is determined the customer's account has been inappropriately used.
Site Content
Fishbowl Network strictly prohibit the transmission
of any material that is, in Fishbowl Network's sole discretion, a violation
of the following:
Illegal material - This includes, but not limited to, copyrighted works,
Mp3, music or video files and any material that is in clear violation
of any applicable law.
Warez - This includes, but not limited to, pirated software, serials,
cracks, roms, emulators and any site which provides "links to" or "how
to" information about such material.
Adult material - Only Content that meets US Federal law and local laws
allowed. All Applicable laws enforced.
Server Use
Accounts provided by Fishbowl Network are to be used
by the primary owner and are prohibited from reselling, storing or giving
away web hosting services to a third party. Web hosting is defined as
a third party hosting any content on the primary owners account.
Fishbowl Network has a zero tolerance policy against spam and unsolicited
mail of any shape or form. If it comes to Fishbowl Network's attention
that an account hosted on Fishbowl Network servers are in violation
of this policy, the account in question will be suspended immediately,
pending further investigation. We do not allow any scripts to be run
that may cause undue loads on the servers, including games servers,
IRC servers, chat room scripts and the like. Any files found to be used
will be deleted without notice.
Unsolicited commercial e-mail / Unsolicited bulk e-mail (SPAM)
Use of the Fishbowl Network service to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited. Violations of this type will result in the immediate termination of the offending Fishbowl Network account.
Backups
Fishbowl Network makes every effort to make weekly backups of all sites currently hosted on its servers. Suspended sites do not get backed up. Although we provide this service for free and for your protection, we can not garauntee that the files will be valid for restoring your site on any server other than ours. We suggest for your own protection, you make your own backups via FTP. Fishbowl Network will not be held responsible for any lost files and or settings due to a site restore or server crash.
Payment
All invoices/request for payment will be sent out on the 15th of each month. It will be sent to the email account on file for your domain administrator. All payments will be due by the 25th of the month. With a 5 day grace period. Fishbowl Network reserves the right to suspend any account until monies owed has been cleared. This includes, but is not limited to, monies owed due to excess bandwidth usage over the agreed limit (charged at $2.00 per Gb). The customer is responsible for all monies owed from the time the account was first established till the time the customer sends in a cancellation request. All invoices will be sent to the default email address provided at registration.
Cancellations & Refunds
Fishbowl Network reserves the right to cancel the
service at any time. In this event, all fees paid in advance will be
pro-rated and refunded based upon the remaining period of membership.
If a customer contravenes Fishbowl Networks terms and conditions or
a cancellation occurs due to breach of these terms, the customer agrees
that no refund is due.
All customers opening accounts for the first time with Fishbowl Network
are entitled to a 14 day money back guarantee. If the customer decides
to cancel his/her account before the end of the 14 day money back guarantee,
the customer is entitled to a full refund (this does not include customers
who are in breach of these terms) excluding any optional extras ordered
at the time of registration or setup fees. Customers will not be entitled
to this trial period if they have held an account with Fishbowl Network
before. Once the trial period is over, customers are not entitled to
a refund unless the service is cancelled by Fishbowl Network.
Indemnification
The customer agrees that it shall defend, indemnify, save and hold Fishbowl Network harmless from any and all demands, liabilities, losses, costs and claims, including solicitor fees asserted against Fishbowl Network that may arise or result from any service provided or performed or agreed to be performed or any product sold by the customer. The customer agrees to defend, indemnify and hold harmless Fishbowl Network against any liabilities arising out of the following:
- Any injury to a person or property caused by any
products sold or otherwise distributed in connection with a Fishbowl
Network server
- Any defective products sold to a customer from a Fishbowl Network
server
- Any material supplied by a customer infringing or allegedly infringing
on the proprietary rights of a third party
- Copyright infringement (including intellectual property)
Security
You are responsible for any misuse of your account,
even if the inappropriate activity was committed by a friend, family
member, guest or employee. Therefore, you must take steps to ensure
that others do not gain unauthorized access to your account. In addition,
you may not use your account to breach security of another account or
attempt to gain unauthorized access to another network or server.
Your password provides access to your account. It is your responsibility
to keep your password secure.
Sharing your password and account access with unauthorized users is
prohibited. You should take care to prevent others from using your account
since you will be held responsible for such use.
Attempting to obtain another user's account password is strictly prohibited,
and may result in termination of service.
You must adopt adequate security measures to prevent or minimize unauthorized
use of your account.
You may not attempt to circumvent user authentication or security of
any host, network or account. This includes, but is not limited to,
accessing data not intended for you, logging into or making use of a
server or account you are not expressly authorized to access, or probing
the security of other networks. Use or distribution of tools designed
for compromising security is prohibited. Examples of these tools include,
but are not limited to, password guessing programs, cracking tools or
network probing tools.
You may not attempt to interfere with service to any user, host or network
("denial of service attacks"). This includes, but is not limited to,
"flooding" of networks, deliberate attempts to overload a service, and
attempts to "crash" a host.
Users who violate systems or network security may incur criminal or
civil liability. Fishbowl Network will cooperate fully with investigations
of violations of systems or network security at other sites, including
cooperating with law enforcement authorities in the investigation of
suspected criminal violations.
Network Performance
Fishbowl Network accounts operate on shared resources.
Excessive use or abuse of these shared network resources by one customer
may have a negative impact on all other customers. Misuse of network
resources in a manner which impairs network performance is prohibited
by this policy and may result in termination of your account.
You are prohibited from excessive consumption of resources, including
CPU time, memory, disk space and session time. You may not use resource-intensive
programs which negatively impact other customers or the performances
of Fishbowl Network systems or networks. Fishbowl Networks reserves
the right to terminate or limit such activities.
Disclaimer
Fishbowl Network will not be held responsible for any damages your company may suffer. We do not make implied, written or expressed warranties of any kind. Fishbowl Network disclaims any warranty or merchantability for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Fishbowl Network. Fishbowl Network reserves the right to revise its policies at any time without giving customers any advance notice.
